Court upholds conviction of man who crashed into Amish buggy

MADISON, Wis. (AP) -- An appeals court has upheld the conviction of a man who crashed his pickup truck into an Amish family's horse-drawn buggy, killing a pregnant woman and her son.

Donald Comstock, 81, was convicted of negligent homicide by operation of a vehicle for the 2004 crash on Highway 61 in western Wisconsin.

Police say the Amish family was returning home from church services when Comstock's truck rear-ended the buggy. The accident killed Mary Stoltzfus and her 12-year-old son, from rural Mount Hope.

The appeals court upholds the jury's verdict. The court says Comstock was not paying attention and he had drifted off the highway before the crash, which happened during good road conditions.

I agree too that it was a tragic accident. Every accident happens because obviously somebody isn't paying attention. But it didn't appear to be intentional. Slower moving vehicles on highways are something that have caught all of us off guard at one point or another. My sympathy to both families.

This man was a customer of mine at a local business. This was an accident...plain and simple. He didn't mean to do it and has to live the rest of his life feeling horrible that it happened. It could have been a 16 year old that did it. I do agree that some older people maybe should not be driving, but that is not the case with this man. People in this world need to realize that accidents happen. As horrible as it is may be that's the way life is.

Some older People should not have a license anymore. What that Family must have endured, i pray for them. But the Amish People are God fearing and forgiving. I pray that the 81 year old does not have a license anymore. But what now, he is old aleady, locking him up won't do any good. But he shouldn't get away with it also.
