Court upholds man's conviction for having sex with dead deer

WAUSAU, Wis. (AP) -- A state appeals court has upheld a Superior's man conviction for having sex with a dead deer.

The 3rd District Court of Appeals has rejected Bryan Hathaway's argument that the charge should be dismissed because the law against committing an act of sexual gratification with animals does not apply to those who are dead.

Hathaway pleaded no contest to the charge a year ago and was sentenced to probation that required him to be evaluated as a sex offender.

The 21-year-old Hathaway told investigators that he saw a dead deer in a ditch near Superior in fall 2006 and could not stop himself from having sex with it after he dragged it into the woods.

Man convicted of assaulting dead deer gets more jail time

SUPERIOR, Wis. (AP) -- A Superior man convicted of having sexual contact with a dead deer will spend another nine months in jail.

21 year-old Bryan James Hathaway had his probation revoked last month for using alcohol and marijuana, lying to his probation agent, and having unapproved contact with a minor child and sexual relations with another adult.

Douglas County Circuit Court Judge Michael Lucci sentenced Hathaway to 9 more months in jail during a re-confinement hearing yesterday.

Hathaway is appealing his conviction on the deer charge.

He was previously convicted of killing a horse with the intention of having sex with it.

Okay. I'm not even going to comment on the necrobestiality, beyond saying that that's actually a pretty old one. (If there's a Biblical injunction against it-- and I think there's one against screwing animals-- it's old news.) It says in the second article, though, that part of Hathaway's probation is becaus he had "sexual relations with another adult." So... if you're on probation, you're not allowed to have consenting sex with other adults? Because, what, you'll contaminate them, or because it's supposed to be a punishment? Very oddly phrased.

Maybe the deer looked different after closing time.This guy has a major problem.I dont think any meds will help him.We need to get some consulers for the animals now.And hes going to be back on the streets?????

hopefully he will get some help. I like everyones opinion on Mendota. But we know judges dont like keeping sickos there either. It appears that he receives his thrill from those that dont fight back. This is very disturbing!

well, if prostitution were legalized...men like this wouldn't have to seek out animals and children. They could just pay for sex. Not that I am sticking up for this sick behavior, but hopefully it would minimize it and the innocent would be left alone.

Sure, first we send him to Mendota, then they say part of his re-integration into society is to take him to Old Country buffet on the east side, then he just "walks away" from the Mendota staff in the restaurant/ parking lot, then he's back in the community! Does anyone else remember that fiasco from a year ago or so? So... let's keep him behind bars, eh? Psychiatrists can talk between bars as well as between chairs! Of course, someone else's idea of euthanizing creeps like this isn't bad, either!

I'm guessing that he won't be allowed at the petting zoo for a little while...or the rodeo, or the zoo or a farm or going sleigh rides. Wow, this guy isn't picky at all -- he'll take whatever he can get!

He's been doing this every since he was about 16. Where is this behavior coming from? I would rather he assaults an animal and not a child. What will happen when he finally gets out of prision? This really scares me. People like this can't be cured. They just get worse.

This individual is a very sick pathetic human. I think subspecies like this belong in insane asylum for the rest of their lives. It is too bad we don't have a law in place that would euthanize creeps like this.
