Son Can be Tried for Father's Murder in WI

The Wisconsin Supreme Court said Wednesday the state does have jurisdiction in the Krnak case.

Attorneys for Derek Anderson had argued that he couldn't be
charged with the murder of his father, Allen Krnak because there was no evidence the crime was committed here. Krnak's remains were found by hunters in North Carolina more than five years ago. An autopsy showed Krnak was killed by a blow to the head.

The justices ruled the state has jurisdiction in the case if it
can establish at least one of two elements -- either the killing,
or an act that establishes the intent to kill was developed here.
The court ruled the state had enough evidence to meet the second
requirement.

Krnak, his wife, Donna, and their other son, Thomas, disappeared
in July 1998 on the way to their Waushara County cabin. Donna and
Thomas have never been found.

Anderson legally changed his name from Andrew Krnak after his
family disappeared. His murder trial was on hold pending the
outcome of his appeal before the state Supreme Court.
