The fate of Janesville's new Wal-Mart and Sam's Super Store on the city's north side could be decided on Wednesday as a Rock County judge prepares to decide if the city was just in issuing permits for the construction of the superstore.
On Tuesday, Rock County Judge James Welker heard two hours of arguments, those opposed to the store say the city planning commission and the city zoning board of appeals ignored concerns about traffic problems at the site and effects on property values in the area.
Attorneys' for the city and the owner of the land say discretion was used when they decided on the development.
