Doctors said a one and a half pound preemie had no chance of surviving. However, the state Supreme Court says that doesn't matter, the child should have had the same medical screenings as every other patient.
Shannon Preston sued Meriter Hospital when doctors refused to treat her infant son. Doctors say he wouldn't have survived because his lungs were so underdeveloped.
Today's Supreme Court decision overturns an earlier appeals court ruling that sided with the hospital. That means the case now goes back to Dane County Circuit Court.
