UPDATE: 4-year-old Starts Deadly Fire Save Email Print

The Janesville Fire Department determined, Monday, a 4-year-old boy, with a cigarette lighter, started Saturday's deadly fire.

Shift commander Tim Ehlers tells NBC 15 investigators believe the fire was accidentally started. He says a 2-year-old was flown by helicopter to Milwaukee, and he has shown "marked improvement." The 2-year-old suffered heavy smoke inhalation.

Both the 2 and 7-year-olds were in first floor bedroom of the apartment. The crew found them inside and handed them out a window. The first floor is where the family lived, and their grandmother lived on the second floor.

Firefighters did not find an adequate number of smoke detectors in the apartment, and noted that the owner will likely be cited for the inadequacy.

Ehlers says that smoke detectors are by statute something that must be present - building owners must provide them, and it is up to the tenant to make sure the battery is working.

**JANESVILLE POLICE REPORT**

On May 10, 2008, the Janesville Police Department responded to assist the Janesville Fire Department with a residential fire at 327 N. Palm Street. The residence is a two unit apartment.

7-year-old Derek R.J. Mattingly died as a result of the fire. A 2-year-old boy was transported by MedFlight to a Milwaukee hospital. A 4-year-old boy escaped with his father, Scott Ashmore. The boys' mother, Kristarra Mattingly, was not home when the fire was reported.

The cause of the fire is under investigation.

A 7-year-old boy died when a fire hit a home on Janesville's west side.

Firefighters said the victim's 2-year-old brother was hospitalized after the fire was reported Saturday about 8 a.m.

Deputy Fire Chief Jim Jensen said the boys' father, another brother described as a toddler, the boys' grandmother and another person escaped.

The cause of the fire was not immediately determined.

I was next door when the fire started and could not believe what happened to derek. He was always at the fence to talk and was always interested in what we were doing. God Bless Your family.

To Mr. Mattingly, I hope you and your family are doing as good as can be expected during this terrible time. Our thoughts go out to you and your family. Now is not the time to point fingers, with that I agree! Provide comfort to those who need it, As a grandpa myself, I cannot imagine the pain you must be going through. I wish you and your family all the luck and hope in the world that your family will get through this!

I am Derek mattingly's Grandfather I would like to take a moment to thank all that have sent their wishes and prayers. They are most needed at this time of tragedy. My Daughter Kristarra and Scott have lost everything in this tragedy. Many speculations and accusations have been made of the possible cause of this tragedy. I feel that we can point fingers and try to blame who we can but the matter is nothing is ever going to replace my Derek. Derek being only seven years old has touched so many lives and hearts within that seven years. We we could only learn to love and care as this little boy did, it would be a wonderful world to live in. He will be greatly missed. Never miss an opportunity to show your love because you will never know about tomorrow. God bless you all.
