Man Arrested for 6th OWI Offense Save Email Print

Monday, September 22, 2008 --- 9:50 a.m.

According to the Dane County Sheriff's Office:

At approximately 4:25 am on Saturday, September 20th, Dane County Sheriff’s Deputies responded to an EMS call on Main Street in the Village of Dane.

The female caller reported an unconscious person inside a vehicle in her driveway. When deputies arrived they contacted Leroy E. Anderson, age 46 of Lodi. Anderson was intoxicated and attempting to drive to his friend’s home nearby.

Anderson was arrested for Operating While Intoxicated – 6th Offense, and Operating After Revocation – 2nd Offense. After being transported to Meriter Hospital for a blood draw, he was booked into the Dane County Jail.

anon 9.24- 12:55 PM- I was really hoping someone would not use the "can you honestly say you haven't..." defense here, just once, a story without that illogical drivel. But, to answer your question, some of us are in our fifties, don't have a first, let alone sixth, OWI because we never have driven drunk, or under the influence of meds, or too tired. we know our body's limits, and are aware what we put into them will affect them, so we don't engage in behavior that is illegal! or dangerous to other people. So, take your defense of we "don't know this guy" and tuck it away somewhere dark and deep. what I do know is that I have never done that stuff, never had that kind of lapse in judgement, even after a few drinks, I use a sober driver, or a cab... so, it is possible, but this person in this story refuses to consider the alternatives, because he appears to have the idea that he is above the law, that rules don't apply to him, and no matter what, he is not going to stop until dead.

How can all of you judge him. You know nothing about his life what he does for a living or anything about his family. How can you say" just shoot him" For driving drunk! when really you should look at yourself and think, how many times have you gone out to dinner and had a couple of drinks, or even after work, or even around the house and then having to go somewhere? That's what I though.And if you think about it, your legally drunk after 3 or 4 beers! I feel that this is a personal matter and should be,and remain between his family and the courts. There are more important things in this world that need our attetion!

anonymous 9-23 8 AM- it has become our business when he chose to operate a vehicle on a wisconsin state roadway after consuming alcohol, and especially after being convicted of the same offense five times previous. so, it is my road too, and I don't want drunks on it, and neither do my neighbors, or my lawmakers, or my police... so he made it "My" business when he put his tires on my roadway and put my life in danger, my family's, my neighbor's families... selfish jackass! they should just take him out back of the courthouse and shoot him. seems every chance he gets, he just throws it away, all the broken promises to the residents of this state that he'll change his ways and not do that again.

Anonymous at 8:54, you and the attitude you display is the prime reason why there is a problem with drunk drivers. You defend their actions and think everyone should look the other way. Sure let's have the media only report the rosey feel good news, that way there will be no debate over tough issues such as these. Do you plan on running for a public servant office in the near future? I think you would fit right in with all the rest of the "do gooders" in public office! When these people are out on our streets driving drunk injuring our children and families, guess what, IT IS OUR BUSINESS!! If you or someone you know ever loses a loved one at the hands of a fool such as this, are you going to have the same attitude? People are angry in part that this person is on his 6th offense and also due to the non-existant penalties handed out by our judicial system to these repeat offenders.

Come on, how do you expect our hard working lawmakers to change a law such as this when they are busy saving so many more innocents by enacting smoking bans in taverns. This guy should (but won't) do years in prison for this. Countries that punish drunking driving much harsher than the U.S. don't have problems with derelicts like this. Don't get me started on the Huber stuff. In my opinion, Huber "sentences" are a joke, and work release should be abolished in this state. If we need to spend more on prisons, so be it. I would rather have my taxes go up knowing people like this are off the street. Plus there will be more prison guard jobs for people who work for companies that Doyle ran out of the state.

Anonymous at 8:54 the FACT is that he was arrested for his 6th OWI. The news reported this FACT. It didn't say convicted, or that he actually did anything, it said ARRESTED and this is a FACT. What other facts are you looking for? Why are you apologizing for him?

Why dont the laws get changed? Could it be that the lobbyists and special interest groups put way too much money in the politicians pockets for campaigns? I do not know the answer but that may be a start. And by the way where is the Tavern League in all of this? As far as writing our Congress or State Representatives even the Governor, I have done that many times over the last 2 years and you know who I have heard back from.... Not a soul! It is a big cash cow for the counties and state. I have said it once and I will say it again. After 2 DUI's your vehicle should be impounded and you will never, ever get it back. Get caught again same happens again and now you will be spending a considerable time in PRISON, not jail or huber center, but prison! I tend bar in Madison and I can tell you this, if this loser ever steps foot in the bar I am working at, he will NOT be served.

anon @ 0854 - arrested for 6th offense means he was out after previously having 5 convictions. That's enough information whether or not the 6th is proven. Wanna keep to yourself, by all means. Denying the problem by only airing good news will only make this particular problem worse.

All you genuises who think you know the law...you can still get OWI even if the car is off and keys are not in the ignition. The officer has more to prove, but if the guy drove to that location and officers can prove he did not drink after parking the car, then he drove to that location intoxicated. Just like when they find a hit and run suspect later and not at the scene. If he's drunk and they can prove he didn't get drunk after the crash, they have OWI!

I think if everyone would just worry about themselves and stop sticking their noses in everyones business the world would be a better place to live in. Don't comment on things until you know the whole truth and all the facts. I always thought everyone was innocent until proven guilty. The news station shouldn't be airing things when they don't have all the facts. They should Concentrate on broadcasting good things in the world and maybe people will start thinking that way.

When is WISCONSIN going to get more strict on these Drunk Driving Laws? My good friend was killed by a drunk driver who had multiple offenses this past May. I am so sick of hearing about people who are being arrested for their 4,5 or 6th offenses and then end up back on the streets. This has got to stop!!

If this was a sexual asault, after the first conviction he would be sitting in prison now with his picture on the internet permanently. Perhaps the goverment can explain why others who commit repeated crimes don't get the same sentence? For that matter why not apply drug dealers and murderers to the permenant interent posting ....

Okay, I feel the minor need to educate. WI state law states someone who is in a position to operate the controls of the vehicle and has a PAC (Prohibited Alcohol Concentration), which is different than BAC, can be charged with OWI. For this guy, .02 is his PAC due to prior convictions. Police still need to prove operation through an interview. We have several different ways to prove operation and whether the drinking occured before the person operated. Believe it or not, we get training on that sort of thing. I know many of you folks in Madison may have a hard time wrapping your brains around the fact that we receive good training, but we do. If you don't think so, go do a ride along anywhere in the south east and see how those police perform their jobs. Anyway, yes, being in the vehicle with a PAC can get you charged for OWI, but only if the police have enough information to prove operation while at or above the PAC.

Why is it people think that the smoking ban is so horrible? I realize that it has affected bar business and that sucks, but don't you think people have a right to clean air and lungs too? It's just as deadly as drunk drivers, maybe more so. And no, I'm not for drunk driving. I think there needs to be vast changes made to the laws in this state and across the country!

indeed a waste of money on the smoking ban. could use it to lock away the drunk drivers. smoking may kill you over 50 years. But this drunken idiot will kill you and your family tonight in less than a second. Pretty sad how they spend money on pre mentioned laws that have no use.

He can be charged with an OWI even if he was sleeping in his car. The reason behind that is if the keys are in the ignition, there is an intent to drive. Not to mention, if he was drunk and stated that he was trying to drive to a friends house, that is a confession.

We have had this discussion many times. If the officer believes that they reasonably could have operated the vehicle they are charged with OWI. One officer on here explained that it is their discretion, if for example someone is sleeping in their car in the bar parking lot, they probably drove their sober and were sleeping it off. They don't deserve one, but they find them at the walmart parking lot, it would lead you to believe they drove their drunk and deserve one.

Does anyone from our government even read or listen to the new? The answer is clearly obvious, they do not or they just don't care what laws in our State really need attention and do something. Instead they waste our money working on bills and laws that are completely useless,(Ex:the smoking ban) or where to cut the budget to benefit themselves and their families as to increase their income and benefits. Why do you think all the criminals, hoods and gangs are taking up residence in our State? Because there is nothing to fear with our judical, court system. anon 11:59 am... if the keys are in the ignition it doesnt have to be running apparently that counts as an OWI... they'll probably go as far as if u have any BAC at all and in the drivers seat.. keys dont even have to be in the car, they'll probably say OWI... it makes sense.. but there are some dark spots not mentioned in the law
