"It's only a matter of time if something isn't done, somebody is going to be killed," Donna Pechan says.

A local woman's worried over what could've happened after police say a repeat drunk driver barrels through a Madison neighborhood.

The crash happened early Tuesday morning near Cottage Grove and Dempsey roads. Police tentatively charged 50-year-old Donald Wiessinger with his 11th OWI offense -- plus several other charges.

"What woke me was the pounding at the door," Pechan says.

Donna Pechan was worried something happened to her daughter, who works overnights. But police were knocking to tell her someone hit a car in front of her home.

"I thought, well, that's a bummer. Until we actually got outside, walked at the other side and noticed the whole side was gone."

Turns out, her daughter's car was hit...

"There are skid marks behind my daughter's car which go about ten feet."

It then slammed into her father's car, which was in front of it.

"I am worried the whole right side's going to fall off while I'm driving."

Moments later, neighbors say they could hear the car coming around the corner on this block... It hit that tree... then another tree across the street and caught on fire.

"He could've hit the neighbor's house. He could've hit our car. He could've hit our house," Ken Koscik says.

Police say an officer who had been trying to stop the suspect, dragged him--unconscious--from the burning vehicle. Police identified the driver as Donald Wiessinger, a man with history of drunken driving.

"I wonder which one is going to be the magic number to where somebody decides he has to go somewhere for quite some time," Pechan says.

Dane County's DA cannot comment specifically on this investigation. But, he but says the legislature recently changed the law for repeat offenders. OWI is a felony at the 5th offense. Now, the law further breaks down maximum possible sentences for repeat offenders.
"It is gradations running upwards," he says.

"10th is the same as 20th, but at least 10th and above is 12.5 years prison exposure," he says, "At least it recognizes the increasing seriousness as people get convictions."

But Pechan wonders how serious before this suspect is unable to get behind the wheel for good.

"I know there's nobody who can babysit him 24-hours a day, but there would be if he were locked up."

In 2004, Wiessinger pleaded no contest to OWI, 9th offense. A newspaper report about the incident says a witness saw a van driving erratically, then crashing into a parked pickup truck. Court records show Wiessinger was sentenced to 34 months in prison.

The man pulled from his burning vehicle early Tuesday morning on Cottage Grove Road isn't facing a seventh drunk driving charge as initially reported by Madison police, but instead will be charged with his 11th drunk driving offense.

Original Story Posted Tuesday, October 14, 2008 --- 8:20 a.m.

Incident Report from the Madison Police Department:

A citizen reported a vehicle driving into parked cars in the 600 block of Cottage Grove Road at 2:14 a.m. An officer responded in to the area and attempted to stop Donald Wiessinger's - age 52 - vehicle.

His vehicle accelerated and he tried to elude the officer. He lost control a short distance later and struck a tree. His vehicle caught fire as a result of the accidents. He was found unconscious in his vehicle with his doors locked. Officers had to force entry into his vehicle to rescue him before firefighters arrived.

He was treated at a local hospital before going to the Dane County Jail.

Suspect:
Donald A. Wiessinger, 52, Madison
Charges: OWI 7th Offense, Eluding, OAR, and several other traffic charges.

whoever said you can't help someone unless they want to be helped is correct. Obviously, he needs motivationI bet 25 years behind bars would be an incentive to clean up his act, given how he won't have anything else to do, except lift weights, watch TV, or walk "the yard" watching the butterflies! Yeah, so maybe on either a really, super hot day, or a really, super cold day, he might choose to be in a climate controlled building instead of out in the elements!

If you are the same Donna mentioned in the article who had the vehicles hit, I am sorry for your loss..am thankful your daughter or no members of your family--or anyone else--were injured at the expense of this sick individual! Sadly, I don't see anyone stopping this individual until he takes a life...just how many chances are we to give someone?

Yep.. that's always the answer, right.. ban alcohol for everyone because of the poor judgement of a few. Punish everyone for the bad decisions made by people like this! I understand alcoholism being a disease but you can't help people that don't want to help themselves and this man obviously doesn't want to help himself. With that, instead of making him the victim, make him responsible for his actions. But that's the OTHER problem with our society.. let's reward bad behavior and make excuses when things like this happen! It only takes one time for him to kill an innocent person but since that hasn't happened yet, he continues to be released from jail. I did not grow up in Wisconsin and it amazes me when I continue to see these stories of people being arrested for their 5th, 7th, 10th, 11th OWI!! How many times is enough??

I remember this guy from a couple of years ago writing in to the Wisconsin State Urinal. Back then he said he had a disease and didn't need to go to prison, and being locked up wouldn't help someone who needed treatment. Maybe if he were locked up for his previous OWI's, this wouldn't/couldn't have happened. I bet if a judge other than a too liberal Dane County judge, this guy would have gone to prison years ago for a long time.

I can understand the alcoholic side of this. But the 11 times thing I can't. Police should be giving people treatment as part of there OWI. After 3 OWI's choices should be in "in"patient treatment or jail.

"praying for him", you want to ban alcohol to help someone like this, even though anyone with internet access can learn how to make their own with basic ingredients. Would you ban the internet to achieve your goal? Maybe ban the books that teach people how to ferment sugar products into alcohol drinks? Wait!! We could ban the products used to make alcohol! And in the process you've destroyed a piece of my liberty, and you have no right to touch my liberty.

Elwood, you're right it is a mental disease. So, what do we do? Maybe after the second offense you should only be able to plea innocent or insanity. Conviction should carry a plenty of time in a mental health facility. And I don't mean AA. Obviously, this guy would be a lifer.

I hope that post was a joke? What's wrong with us people? He's "most likely" suffering from alcoholism? Well, of course he's suffering from alcoholism, there's no "most likely" about it- I work at Dane Co. Detox for Heaven's sake, I DO understand alcoholism, but he demolished my cars when he hit them, he could've killed my family if they were in the car, he could've smashed right in to my house! I have and am currently dealing with my share of issues, none of which would EVER give me an excuse to jeopardize the health and safety of anyone else, no matter what! My family & I are now suffering from his alcoholism as well, and someone in the future is bound to pay for his alcoholism with their life, because he will not stop doing this!! He's proven that. I work at Detox, I have family members who are alcoholics, I UNDERSTAND alcoholism - there is NO justification for what he's being allowed to do over and over... This needs to stop and I'm going to do whatever I can to help stop him.

Elwood...I agree that alcoholism is a serious disease. I have lost 3 siblings to it's direct results. But, understand that people get furious when another person continues to endanger life and property. There are treatment centers for alcoholism, easily accessible to ANYONE who wants it. To willfully continue down a path of self destruction means that that person needs to be locked up ! Every person in the community has the right to expect nothing else.

GIVE ME A BREAK ELWOOD! He is clearly NOT a victim. I'm so sick of people using alcoholism as a crutch and an excuse to get out of punishment for their horrible crimes. I have alcoholism in my family and NONE of them have OWI's or have committed crimes because of it. Get this man off of the streets before he kills your family or mine. There needs to be stiffer penalties for repeated drunk drivers because clearly what is in place isn't working.

Although I am ashamed to say, I shared a bunk with Don in the Dane County Jail in 2007. In the many mind numbing conversations I had with Don, the most alarming was his defying declaration that no one man or entity would stop him from drinking and driving. He spoke of his entitlement to behave as he choose, all while improperly quoting the constitution as his guide to moral insolvency. I believe in addiction and I believe in rehabilitation, but I sat in the company of this man and he believes in only his divine province to honor himself with a blatant disregard for anyone else. People make mistakes, but Don always made it clear the only mistake he made in his life was getting caught. I believe in the inherent goodness of man, but I fear Don is not a good man. He told me directly he would do this the moment he was released, and now look what he has done. My sympathies to those of you who were affected by this man because he will carry neither regret nor remorse.

What happened to the 3 strikes law? I thought if you got 3 felonies (5th Drunk Driving ) you were locked up for life? Failed judicial system and/or corrupt lawyers?! I'm sorry to hear about the parked cars that were hit - hopefully you have uninsured motorist insurance or maybe homeowners will cover it? I doubt you'll get resistution from this guy :(

I sure hope he has about a billion dollars stuffed in his matress at home to pay for the damages, because it is pretty apparent that no insurance company in their right mind would offer this guy any insurance- high risk, sr-22 (or whatever that is that convicts can get)... so, it is all in his posessions... hopefully civil cases, or perhaps a class action suit, can be filed against him, and they can force him to sell his assets to pay for the damages or something! if he has a house, they should sell that, because if he gets what he deserves after 10, he won't ever be leaving prison!

First of all, this man has a conviction on CCAP for his 9th OWI, so where talk of his 7th is coming from, I'm not sure, this would be his 10th! Secondly, OUR cars are the "parked cars" that were hit (photo posted in nbc15photos). We're on a limited income, simply getting a new car, or even having the pile of scrap metal thats left of our cars towed is not a simple thing. This man has left us without a vehicle because he hit them BOTH! There is NO back end to one of our cars anymore! The morning it happened, I was simply in shock. Now, the more information I find on him the more angry I am. I don't understand how this was allowed to happen. He has an almost identical accident/police report four years ago (hitting parked cars) - and he's out this soon to do it again? I don't know where to go or how to start, but my voice is going to be heard throughout his court process this time - I am furious! He will see prison time for this, but he'll soon be out doing the exact thing again.

should've let him fry. you know, disease or not, wanting treatment or not, we all have rights in society not to be threatened by every car that passes us!Most of them are law abiding citizens, but you know, after 7 do overs, it is time to tell this guy no more, ever. get a bus pass, and if they ever catch him in a car behind the wheel again, he gets put down like a rabid animal, because they can't be cured either!

Autum Leaves, There is nothing anyone can do. Judges get caught, prosecutors too, police and lawyers, and politicians, sports heros and common men.There are already web sites made that tell of hundreds of sad stories of inocent people killed by drunks.The problem is, nobody cares. 1700 people in Wi will die this year at thier hands.Another 44000 will recieve DUIs. My family have all made a plea to our legislature (Assembly Bill 490) The reality is if we wanted to stop drunk driving today, we could do it. Not through statutes, not through the courts. Technology is available to stop drunk driving.

I agree that it is time to have a lot tougher drunk driving laws in Wisconsin. What is scary is the fact that this is the 7th time he was caught but how many times has he driven drunk and not gotten caught? Scary thought.

These drunks have had enouph time to quit before they kill themselves or others. My brother was killed August 11, 2007 from a guy on his fifth DUI, and last July my daughter Nicole was killed by a drunk boater while out fishing. Its time we make a stand people, with a drunk killing someone every 37 seconds (National average), your family is at risk. This is a pandemic disease.

The police continue to crack down and the judges continue to let drunk driver off the hook! What do you expect with liberal judges, "everyone deserves a third, forth, fifth, sixth, seventh, eighth, ninth, chance" mentality. It is getting old. I think judges need to be held accountable for people they let off the hook, who then go and kill innocent people while drunk driving!

do lawmakers ever read the paper or police reports???? How can this become such a huge issue and nothing seems to get better, or stiffer penalties are not in place. These people keep doing this and have no fear of keeping on doing it because they know they will just get their license suspended again, and what do they care they will just drive anyway. It just makes me sick that when I have my family on the road I have to worry about these idiots! Something is not right!

This guy ended up in a neighbors driveway at 4214 Major Ave. The fire from his engine lit up the whole block. There are a number of children that live on this residential street. Fortunately they were all in bed. Some tree in the neighborhood was not as lucky.
