UPDATE: Pedestrian Struck in Roadway

BARABOO, Wis. (AP) -- Investigators in Baraboo are working to reconstruct an accident that caused fatal injuries to a pedestrian.
Police Lt. Rob Sinden says no decision has been made on whether authorities will recommend charges against the driver of the van that hit Ronald Brayer Friday.
The 66-year-old Baraboo man died Monday afternoon at University Hospital in Madison.
Brayer was crossing the street near the Sauk County Courthouse square when he was struck by the van, which was backing up.
The van was driven by a 51-year-old Merrimac woman.

On April 17, 2009 at approx. 6:40pm the Baraboo Police Department responded to a report of a pedestrian being struck on the 600 block of Oak Street. Upon arrival, Baraboo officers found Ronald J. Brayer, a 66 year old Baraboo male, had been struck by a vehicle. Baraboo Emergency Medical Personnel arrived and began tending to Brayer.
Investigation of the incident revealed Ron Brayer was walking across the 600 block of Oak Street when a 2004 Chevrolet Astro Van, operated by Debra Althen, a Merrimac woman, was backing in the roadway in the same location. The van struck Brayer causing him to fall to the roadway where he did sustain severe injuries requiring emergency medical attention.
The incident remains under investigation by the Baraboo Police Department and Wisconsin State Patrol.

Tom, the only time a pedestrian has the "right of way" is when they are crossing the street at a cross walk. And yes, it is a state law that cars are to stop when pedestrians are going to croos in a cross walk.

Pedestrians don't always have the right of way. They can't just walk randomly into traffic and expect all cars to come to a screaming halt.

Whether or not pedestrians have the right of way, the laws of physics apply; pedestrians can't just put up a shield to make them impervious to automobiles. It's sad this played out how it did. A simple look in the mirrors (like you're supposed to) by the driver could have alerted her to his presence. And if he had watched for signs the van may move, he could have moved away from it. Very sad for all involved.
