Theft Victim Sits on Crook
Man sits on suspected burglar until officers arrive. INSIDE: Incident report from Madison Police Department.

A 23-year-old thief gets a lot more than he bargained for with a North Madison Couple.

Their method? Certainly not what police recommend, but they say instincts just took over.

Most people wouldn't think about running out the front door half naked, much less doing it when you're heading into a potentially very dangerous situation.

Kathy Moen says, "I was just really scared, yeah, even though they're outside it's a weird feeling."

A thief rummaging through her stuff isn't exactly the wake up call Kathy Moen was hoping for but that's exactly what she saw when she looked out her bedroom window around 3 o'clock Wednesday morning.

She says, "Immediately when I turned the fan off I heard another noise and I'm like that's it, I'm calling the police. Somebody is in that trailer. I sat on the floor and I'm like you need to hurry somebody is in my trailer."

But her husband Kevin wasn't about to wait for police when he saw the thief walk around the front of the house to the car.

He says, "I seen him in the car and I thought this is my chance."

Kathy says, "I'm said you are not going out the door and 2 seconds later he's out the door."

Kevin ran out, slammed the car door on the man and caused this dent when he threw him into the car.

After he grabbed the thief the two actually wrestled around in the driveway for a while until he finally got a hold of him, sat on him and held him here until police arrived.

Kevin says, "He was had. He wasn't going anywhere and if you saw someone sitting on you in their underwear you'd probably freak out too. He probably seen me with my big fat belly and my underwear and got scared right there."

The man, 23 year old Moses Garcia was arrested for theft and disorderly conduct. Kevin escaped without a scratch.

He says, "It's instinct. It's your property. Somebody shouldn't be messing with it and especially my race car trailer, kids are gone and that's all I got left now."

Kevin's wife Kathy is relieved. She says she was just worried the thief may have had a gun or knife and how's this for a tough guy? At 54 Kevin drags down this thief one year after recovering from a heart attack.

From Madison Police:

A woman who lives on Utah Court called 911 early Wednesday morning to say she had spotted a thief behind the house, and that her husband was now sitting on the crook.

Officers arrived and arrested the man.

The woman explained a noise behind the house had awakened her and she looked out and spotted the suspect inside a trailer.

She got her husband up, and he quietly slipped out the door.

The suspect, clueless about being spotted, moved from the couple’s trailer into their car.

The 54-year-old husband confronted the younger man.

After a struggle the husband wrestled him to the ground and sat on him.

Officers found several items: tools, a man's watch etc.which had been stolen from another unlocked vehicle in the neighborhood.

Arrested:
Moses S. Garcia, 23, no permanent address
Charges: Theft (2 counts), Disorderly Conduct.

He really is lucky that home owner did not shoot him! Glad he did not break into our house because the dog would have ripped him to shreads!

Good for the homeowners for catching the crook. Of course now Garcia is still stealing from us (taxpayer funded jail), but at least he's off the streets.
