Man Receives 5th OWI in Grant County

Release from Grant County Sheriff:

On 1/20/2012, at 8:32p.m., Grant County Deputy Andrew Smith conducted a traffic stop on a 1995 Chevy truck on Sportsmans Drive in the Village of Muscoda. The stop was conducted because the driver, David Hagenston, wasn't wearing his seatbelt. The deputy made contact with Mr. Hagenston and detected a strong odor of intoxicants coming from him. Mr. Hagenston attempted several field sobriety tests, which showed his ability to operate a motor vehicle was impaired. The deputy placed Mr. Hagenston under arrest for OWI, fifth offense, which is a felony and he's currently being housed in the Grant County Jail without bond.

    regardless if the officer hates him or not dude was driving drunk....5th time...he obviously has problems, i hope he sits for a long time n the cop keeps on nailing this morons n makes r roads safe!!!!!!!

    You are defending a drunk that has been caught 5 times and who knows how many other times he has drove drunk. Does he need to hit and kill someone for you to be ok with it? He is very lucky I wasn't the arresting officer!!!

      I am very close to this family and I KNOW the truth, you do NOT know any circumstances and again I reiterate the questionable authority give to this deputy. I am NOT condoning his behavior but there is more to this officer's grudge. The end.

    How would an officer see that a person wasn't wearing his seatbeat at 8:30pm on an unlit side road? Internal Affairs needs to investigate this officer who has had a well known and long going grudge against Hagenston's family member over a bad relationship. Unfortunately officers of the law are often the ones that break it the most.
