MADISON, Wis. (AP) -- The Wisconsin Department of Justice has decided not to launch an internal investigation of an agent accused of illegally manufacturing and selling guns.
Former Special Agent Dan Bethards accused his supervisor, Jay Smith, of making and selling guns to other law enforcement officers, including Attorney General J.B. Van Hollen, without a federal permit. A federal investigation into the accusations closed in October without any charges.
DOJ officials were contemplating launching an internal probe into Smith. But Assistant Attorney General Kevin Potter wrote in a letter responding to an open records request from The Associated Press that agency officials reviewed the federal investigation and found Smith hadn't violated any laws or any policy or work rules and decided not to open an internal investigation.
