UPDATE: Douglas Co. DA clears deputy in fatal shooting

UPDATED Friday, September 20, 2013 --- 9:02 a.m.

SUPERIOR, Wis. (AP) -- A Douglas County sheriff's deputy has been cleared of possible charges in his use of deadly force.

District Attorney Dan Blank determined Lt. Christopher Hoyt fatally shot 21-year-old Andrew Closson after Closson pointed a rifle at the deputy on New Year's Day. Blank says Hoyt was faced with a deadly threat and responded in a reasonable manner.

The Duluth News Tribune says Hoyt was responding to a report of shots fired at a residence in Gordon when he encountered Closson hitchhiking along Highway 53. Authorities say Hoyt got out of his vehicle, told Closson to show his hands, then fired three times as Closson pointed a long gun at the deputy.

TOWN OF GORDON, Wis. (AP) -- A sheriff's deputy in Douglas County shot and killed a man who authorities say pointed a rifle at the officer.

The deputy was unhurt in the incident early Tuesday. The Duluth News Tribune reports that officers were called to a domestic disturbance with a report of gunfire at about 1:40 a.m. at a home in the Town of Gordon, about 40 miles south of Superior.

Sheriff Tom Dalbec says the suspect fled the residence, but was found a short time later walking along a highway. When a deputy confronted the man, the suspect allegedly pointed a rifle at him which prompted the deputy to fire his weapon at the suspect. The man died a short time later at a hospital in Duluth; his name has not been released.

The deputy has been placed on standard paid administrative leave.
