UPDATE: Lawyers Ask Wis. Court to Rule in Prayer Death

MADISON, Wis. (AP) -- A state attorney tells the Wisconsin Supreme Court a couple caused their daughter's death when they prayed over while she slowly died of diabetes.

Dale and Leilani Neumann were convicted in 2009 of reckless homicide in the death of their 11-year-old daughter, Madeline. Their attorneys have asked the Supreme Court to reverse their convictions, arguing state law protects prayer healers and the statutes aren't clear on when a situation becomes so serious they must seek medical help.

Assistant Attorney General Maura Whelan told the justices Tuesday parents who pray over an ailing child can't be charged with child abuse but their immunity doesn't apply if the child dies.

She says the Neumanns placed Madeline at a substantial risk of death and had to have known they crossed the line.

MADISON, Wis. (AP) -- Attorneys for a Wisconsin couple who prayed while their young daughter died in front of them of treatable diabetes are set to try to persuade the state Supreme Court to clear the couple of any wrongdoing.

According to court documents, Dale and Leilani Neumann's daughter became gravely ill in March 2008. Rather than seek medical attention, the Weston couple prayed over her until she died Easter Sunday. Separate juries convicted both of them of second-degree reckless homicide.

The couple's lawyers maintain Wisconsin statutes permitting parents to treat their children through prayer protects them from prosecution even if the child dies. Prosecutors contend the right doesn't extend to inflicting death.

The two sides are scheduled to present oral arguments to the court Tuesday.
