MADISON — On Wednesday, September 14, 2011, in Marquette County Circuit Court, Benjamin Kamedulski was sentenced to 24 years of imprisonment after having previously pleaded no contest to a charge of second degree reckless homicide in the death of his six-month-old son.

Kamedulski’s sentence includes 18 years of initial confinement and six years of extended supervision. The court further ordered that the sentence be consecutive to Kamedulski’s current sentence on a drug offense.

According to the criminal complaint, on March 18, 2009, Kamedulski’s son suffered blunt force trauma and other injuries consistent with being shaken and then impacted.

Assistant Attorney General Richard J. Dufour, citing the heinous nature of the crime and Kamedulski’s lengthy criminal record, asked for a 30 year sentence that would have included 20 years of confinement and 10 years of extended supervision. Assistant Attorney General Dufour also requested the sentence be consecutive to Kamedulski’s current sentence.

The state was represented by Assistant Attorney General Dufour, who had been the District Attorney for Marquette County at the time the plea was entered in July of 2011.

MONTELLO, Wis. (AP) -- A charge of first-degree reckless homicide has been filed against a town of Neshkoro man in the death of his 6-month-old son.

A criminal complaint filed against 27-year-old Benjamin Kamedulski said he called 911 on March 18, saying the baby was injured in a fall down the stairs.

The boy died March 20, and doctors later concluded the injuries were inconsistent with that type of fall.

An autopsy attributed the death of Ian Kamedulski to blunt force head trauma.

Kamedulski was charged Wednesday and is scheduled to make an initial appearance Monday in Marquette County Circuit Court.
