UW Health Transformation surgeon accused of neglect, sexual exploitation
A lawsuit has been filed against a plastic surgeon with UW Health Transformations.
The medical malpractice lawsuit claims John W. Siebert, M.D. “failed to use the degree of care, skill and judgment that reasonable physicians would use in the care and treatment of a patient.”
The lawsuit was filed on Feb. 1, 2019 with the Dane County Circuit Court.
According to the complaint, a female patient asked Siebert to perform a breast augmentation and ‘tummy tuck.’
The court documents claim during follow-up visits, due to surgical complications, Siebert inappropriately touched the patient’s shoulders, face, and legs. The documents also claim, he inappropriately called her names such as ‘sweetie’ and ‘babe.’
The lawsuit claims the patient felt ‘completely violated,’ after learning about alleged past sexual misconduct by Siebert.
The complaint said from 2006 to 2008 Siebert was being investigated for an alleged sexual relationship with a married patient while working at a hospital in New York. In 2011, he was hired by UW Health Transformation while an investigation into the alleged sexual relationship by the New York State Office of Professional Medical Conduct was ongoing.
In 2013, the New York State Office of Professional Medical Conduct concluded it's investigation. The New York medical board suspended Siebert's medical license said he must be accompanied by a chaperone when attending to female patients. Following the investigation, UW Health Transformations implemented a chaperone policy for Siebert.
The patient requested breast implants 225 to 250 cubic centimeters in size. The patient believes Siebert used 305 and 375 cubic centimeter implants instead, according to the complaint.
The complaint said the patient located ID cards after the surgery, which detailed the breast implant sizes and “violated [the patient’s] authorization."
Court documents say the patient lives in Wausau and is a marathon runner, triathlete, boxer and the mother of three.
The case mentions five defendants: John W. Siebert, M.D., UW Health Transformations, ABC Insurance Company, DEF Insurance Company, and Security Administrative Services.
